New Jersey’s deepfake statute
(P.L. 2025, c. 40), signed by Governor Murphy in April 2025, gives victims a direct right to bring civil claims for actual damages, punitive damages, and attorneys’ fees and explicitly preserves common law privacy torts including invasion of privacy, misappropriation of identity, and false light.
Pennsylvania’s Act 35 of 2025
PA Act 35 establishes criminal liability for creating a “forged digital likeness” of a real person without their consent and with intent to defraud or injure.
Government and Regulatory Actions Against xAI
The conduct alleged in these cases has drawn formal government action across the United States and internationally.
In the U.S., the California Attorney General launched an investigation into xAI on January 14, 2026, and issued a cease-and-desist letter two days later, on January 16, demanding that xAI immediately halt the creation and distribution of nonconsensual deepfakes and child sexual abuse material. New York’s Attorney General led a bipartisan coalition of 35 state attorneys general formally demanding action from xAI. Baltimore became the first U.S. city to file suit against xAI directly, in March 2026. France opened a criminal investigation into xAI’s conduct; regulatory proceedings are also underway in the United Kingdom, Ireland (under EU jurisdiction), Australia, and India.
